- Annotation: The article deals with the problem of indivisibility of the thing, a major challenge for civil law doctrine over ages. In author’s view, the lack of satisfactory solutions to this problem stems from a methodological flaw referred in the work as ‘metaphysical’. Combined with mistakes in the construction of Art. 133 of the Russian Civil Code, this approach leads to legal proceedings which fail to provide a fair solution to indivisibility issue. Courts may either ignore interests of the parties involved in the dispute altogether or replace them with a construed concept of the perception held by participants of legal turnover. The author also investigates epistemological and historic roots of this tradition, particularly in the German and French doctrine. The author’s own approach suggests taking into account the interests of those individuals who are the parties to the dispute. Whether a thing acts as a single entity in turnover is solely dependent on the nature of its value for the persons who may be affected by the outcome of this case. Provided is some case modelling to show practical consequences this approach involves. After exposing various options of amending the current law, the author puts forward proposals he deems will serve best to cope with the issue of indivisibility.
